Ruling On Health Insurance - al 'Uthaymeen - حكم التأمين الصحي - ابن عثيمين

Translation:-

Shaykh Muhammad ibn Saalih al-'Uthaymeen (Rahimahullaah) -
"Question .... if a person gives the insurer ... for example if he gives the insurance company a certain amount of money every month and than he never gets sick ... so who is winning and who is losing ? The insurance company is winning by taking his money and there is no benefit for him. What if he is inflicted with many illnesses ? Than the cost would be more than the amount he paid. So who is winning ? It is the person. This type of transaction / contract is a form of gambling that Allaah prohibited. Allaah states in the Qur'aan [ ( Surah Al Maedah 5:91) O you who believe! Intoxicants, Gambling, and Al-Ansâb (sacrificing to idols), and Al-Azlâm (arrows for seeking luck or decision) are an abomination of Shaitân's (Satan) handiwork. So avoid (strictly all) that (abomination) in order that you may be successful.]"

"Gambling is not permitted. For example if one is forced to have health insurance. Than he pays and if he is inflicted with illness which requires treatment. Than he only takes as much as he paid from the insurer (insurance company)."

Questioner #2 -
"When the person pays per month, in reality the insured receives the same amount he paid, because he goes to see a doctor for the initial assessment and with the discovery of the illness he starts receiving treatment. So you can see from this that each person from the society pays a certain amount of money. At the end of the year if he needs treatment than he has already paid for it, and if he isn't in need of any treatment that the amount he paid goes to the cost of the doctors initial assessment."

"Gambling is not allowed in any form and is it worse than the interest on money because Allaah states in the Qur'aan in chronological order - [ (Surah Al Maedah 5:91) ... As-salamu `alaikum warahmatullah wabarakatuh (May Allah's Peace, Mercy, and Blessings be upon you!)
With reference to your letter No. (522/9), dated 25 Rajab, 1407 A.H. which was accompanied by the letter of the General Director of Medical Affairs in Al-Madinah Al-Munawwarah, concerning Al-Fahd Clinic in Al-Madinah, which has begun to offer health insurance. According to this insurance system, a sum of money is deducted in advance in return for free one year treatment services for an individual or a family. You ask for a Fatwa (legal opinion issued by a qualified Muslim scholar) in this regard.

I would like to inform you that what you mention is a form of commercial insurance which the Permanent Committee for Scholarly Research and Ifta' issued a Fatwa prohibiting it. Attached is a copy of this Fatwa.
